6. Subscriptions and Payments

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECURUSMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.
This includes but is not limited to damages arising from:
- Your use or inability to use the Services
- Unauthorized access to or alteration of your data
- Third-party conduct or content on the Services
- Any security breach or data loss
- Errors, mistakes, or inaccuracies in content
IN NO EVENT SHALL SECURUSMIND'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE ONE (1) MONTH PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless SecurusMind, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your Content or any content you submit through the Services
- Your violation of any applicable laws or regulations
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
If you have any dispute with us, you agree to first contact us at contact@securusmind.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings.
13.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration organization. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.
13.3 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the applicable laws, without regard to conflict of law principles.
Any disputes not subject to arbitration shall be brought exclusively in the appropriate courts, and you consent to the personal jurisdiction of such courts.
15. Termination

You may terminate your account at any time by contacting us or using the account closure feature in your account settings.
15.2 Termination by Us
We may suspend or terminate your access to the Services immediately, without prior notice, if:

- You fail to pay applicable fees
- Your account is inactive for an extended period
- We are required to do so by law
- We decide to discontinue the Services
15.3 Effect of Termination
Upon termination, your right to use the Services will immediately cease. We may delete your account and all associated data. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You represent that you are not located in a country subject to embargo or designated as a “terrorist supporting” country, and that you are not listed on any government list of prohibited or restricted parties.
